These Provider Terms explain what it means to act as a Provider on Werks International Information Services (“Werks”). By creating a Provider profile, accepting bookings, or using the Werks app as a Provider, you agree to these Terms.
By acting as a Provider you enter into an independent contractor relationship with Werks International Information Services. You are not an employee or agent of Werks, and you are responsible for your own taxes, licenses, permits, and compliance with local laws. You must be at least 18 years old and legally able to enter into contracts.
You agree to keep your profile, services, and pricing accurate and up to date, to treat Clients respectfully, and to comply with all applicable laws. Werks may remove content or suspend accounts that are fraudulent, abusive, unsafe, or otherwise violate these Terms or community guidelines.
You are solely responsible for the Services you provide to Clients. You agree to provide Services on time, as described, and in a professional manner, and to follow all relevant safety rules and industry standards. You must immediately report any serious safety or misconduct incidents you become aware of.
Clients pay a Booking Price that may include your service fee and Platform fees. Werks will pay you your share of completed bookings after any holds, refunds, or chargebacks are applied. We may adjust or set off payouts to account for refunds, credits, disputes, promotions, and processing fees.
Client cancellations more than 48 hours before the scheduled start time are free: the Client receives a full refund of the Booking Price (excluding any non‑refundable Platform fees), and you do not receive a payout for that booking.
If a Client cancels within 48 hours of the scheduled start time, Werks may charge a late cancellation fee equal to 20% of the Booking Price. Of this 20%, 10% of the Booking Price is paid to you and 10% is retained by Werks, and the remaining 80% is refunded to the Client (excluding any non‑refundable Platform fees).
No‑shows by the Client may be treated as a late cancellation, and Werks may apply the same or similar fee structure. If you cancel a booking (except for genuine emergencies or force majeure), the Client is usually entitled to a full refund and you will not receive a payout or late cancellation fee.
Werks may, in good faith and in accordance with its policies, issue full or partial refunds or credits to Clients for cancellations, no‑shows, poor quality or incomplete Services, or other complaints. Any such refunds or chargebacks may reduce your payouts or be set off against future payouts. In some cases we may invoice you for negative balances.
You must not use Werks to offer, solicit, or facilitate prostitution, escorting or companionship services where sexual activity is expected or implied, or any paid sexual activity of any kind. You must not advertise massages, bodywork, or similar services that are primarily sexual in nature, or any service that involves or suggests sexual contact or sexual exploitation.
You must not upload or display nudity, sexually explicit images or poses, or overly provocative or fetishized attire where the primary purpose is sexual arousal. You must never post sexual or suggestive content involving anyone under 18. Violations of this section are considered a serious breach and may result in immediate termination and reporting to law enforcement.
Werks collects and uses your data in accordance with its Privacy Policy, including for operating the Platform, processing payments, supporting users, and meeting legal obligations. You agree not to misuse Client contact details (for example, for spam or sharing with third parties) and to keep all personal data secure and confidential.
Werks owns the Platform, app, and related technology. You own the content you upload but grant Werks a license to use it to operate and promote the Platform. You agree not to systematically steer Clients away from Werks to avoid Platform fees for the same or similar Services, and Werks may suspend or terminate accounts that deliberately circumvent the Platform.
To the maximum extent permitted by law, Werks does not guarantee any minimum number of bookings or earnings, and its liability to you is limited as set out in the full Provider Agreement. You agree to indemnify Werks against claims arising from your Services, your legal or policy violations, or your misuse of the Platform. By using Werks as a Provider or tapping “I Agree” in the Werks app, you confirm that you have read and understood these Provider Terms, that you will comply with Werks’ cancellation, refund, and content rules, and that you will not use the Platform for prostitution, escorting, sexual services, or sexually explicit/provocative content.
